1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of PokerBuddy (the "Service"), an AI-powered poker strategy advisor provided by Dodo Labs LLC ("we", "us", or "our"), a Wyoming limited liability company. By creating an account, downloading the application, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Description of Service

PokerBuddy is a strategic validation and educational feedback tool for online poker players. You submit your current game state to the Service; the Service applies game theory optimal (GTO) principles and exploitative reasoning to return a recommended action and supporting explanation (on eligible tiers).

All decisions about how to act on any recommendation — including whether to follow, deviate from, or ignore it — are made solely by you. The Service does not interact with any poker client, does not automate any gameplay, and does not execute any action on your behalf. PokerBuddy is provided for educational and strategic-validation purposes. You are always the decision-maker.

3. Eligibility

You must be at least 18 years old (or the minimum age for online poker in your jurisdiction, whichever is higher) and legally able to enter into contracts to use the Service. By using the Service, you represent and warrant that you meet these requirements. You are solely responsible for ensuring that your use of the Service complies with all applicable laws, including laws governing online poker in your jurisdiction.

4. Account Registration

To use the Service, you must create an account with a valid email address and password. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.

5. Subscriptions and Decision Limits

The Service offers a free tier (35 decisions per week), paid monthly subscription plans, and one-time top-up credit purchases. All charges are processed immediately at checkout through our payment processor, Stripe.

  • Subscription tiers grant a weekly decision limit that resets at 00:00 UTC every Monday. Unused weekly capacity does not roll over; it expires at the next reset.
  • Top-up credit packs are supplemental one-time purchases that automatically extend your usage when your subscription limits are reached. Top-up credits never expire and remain in your account indefinitely.
  • Cancellation: You may cancel your subscription at any time from your dashboard. Your plan remains active until the end of the current billing period.

6. Refund Policy

Each account is entitled to one (1) one-time pro-rated refund during its lifetime, no questions asked. This is our money-back guarantee for first-time purchasers who decide the Service isn't a fit.

The refund amount is calculated as: (time remaining in the billing period ÷ total time in the billing period) × amount paid. Time remaining is computed continuously to the second, not rounded to whole days, so mid-day refund requests are not penalized. Refunds only apply to the current billing period of a subscription; prior periods are not eligible.

For example, if you cancel a $199 Plus subscription 7 days into a 30-day billing period, your refund would be approximately $152.57 (23 days remaining ÷ 30 total days × $199).

To request your one-time pro-rated refund, email support@pokerbuddy.ai from your account email. The refund will be issued to your original payment method within 5-10 business days.

After your one-time refund is issued, all subsequent subscription charges and top-up purchases are final sale, including any resubscription after cancellation or any new top-up purchase. By resubscribing or purchasing additional top-up credits after a one-time pro-rated refund, you acknowledge and accept this no-refund policy for such purchases.

We reserve the right to deny a refund request where we detect abuse patterns (such as repeated sign-up-use-refund cycles across related accounts).

7. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law
  • Share, resell, or redistribute your account credentials or Service access
  • Reverse engineer, decompile, or attempt to extract the source code
  • Use automated tools, scripts, or bots to access the Service beyond the provided client application
  • Automate or forward any recommendation the Service provides to a poker client, bot, or any system that executes gameplay actions on your behalf
  • Create multiple accounts to circumvent usage limits or other restrictions
  • Interfere with or disrupt the Service or its servers
  • Use the Service in any jurisdiction where online poker or related tools are illegal

8. Compliance with Poker Platform Terms

By using the Service, you expressly represent and warrant that your use of PokerBuddy is permitted by the terms of service of any online poker platform on which you play. Some platforms prohibit the use of third-party strategy tools; you are solely responsible for reading and complying with each platform's rules. We make no representation that the Service is permitted on any specific platform.

Any consequences arising from your use of the Service on a platform that prohibits or restricts such tools — including account suspensions, confiscation of funds, civil or criminal claims by the platform, or tournament disqualification — are your sole responsibility. You agree to indemnify and hold harmless Dodo Labs LLC from any claims arising from your violation of any third-party platform's terms of service in connection with your use of the Service.

9. Responsible Gaming

Poker involves the risk of financial loss. You should only play with funds you can afford to lose and should set personal limits on time and money spent playing. The Service does not guarantee winning poker outcomes and is not a substitute for sound bankroll management or judgment.

All content, software, algorithms, and materials provided through the Service are owned by Dodo Labs LLC and protected by copyright, trademark, and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes, subject to these Terms.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT RECOMMENDATIONS PROVIDED WILL RESULT IN WINNING POKER HANDS. POKER INVOLVES CHANCE AND RISK OF LOSS.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DODO LABS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

13. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason, with or without notice. Upon termination, your right to use the Service will cease immediately. Any remaining capacity within the current billing period is forfeited upon termination; top-up credits are preserved per §5.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

15. Arbitration and Class Action Waiver

Any dispute arising from or relating to these Terms or the Service shall be resolved by final and binding arbitration, rather than in court, except that you may assert claims in small-claims court if your claims qualify. The Federal Arbitration Act governs the interpretation and enforcement of this provision. Arbitration shall be administered by JAMS ( jamsadr.com) under its Streamlined Arbitration Rules, and shall take place in Sheridan, Wyoming, or via videoconference at the arbitrator's discretion. The arbitrator's decision is final and binding and may be entered as a judgment in any court of competent jurisdiction.

Class Action Waiver. You and Dodo Labs LLC agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding. If a court finds this class-action waiver unenforceable, the entirety of this Section 15 shall be void and disputes resolved in court under Section 16 (Governing Law).

Opt-Out. You may opt out of this arbitration provision by emailing support@pokerbuddy.ai with subject line "Arbitration Opt-Out" within thirty (30) days of first accepting these Terms. Opting out does not affect your access to or use of the Service.

16. Governing Law

These Terms are governed by the laws of the State of Wyoming, without regard to its conflict of law provisions. To the extent any dispute is not subject to arbitration under Section 15, it shall be resolved in the state or federal courts located in Wyoming.
