1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of PokerBuddy (the "Service"), an AI-powered poker strategy advisor provided by Dodo Labs LLC ("we", "us", or "our"), a Wyoming limited liability company. By creating an account, downloading the application, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Description of Service

PokerBuddy is a software application that provides strategic recommendations for online poker players. The Service analyzes game state and offers decision guidance based on game theory optimal (GTO) principles and exploitative adjustments. The Service is provided for educational and entertainment purposes only.

3. Eligibility

You must be at least 18 years old and legally able to enter into contracts in your jurisdiction to use the Service. By using the Service, you represent and warrant that you meet these requirements. You are solely responsible for ensuring that your use of the Service complies with all applicable laws, including laws governing online poker in your jurisdiction.

4. Account Registration

To use the Service, you must create an account with a valid email address and password. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.

5. Subscriptions and Credits

The Service offers a free tier with a limited number of daily decisions, paid monthly subscription plans, and one-time credit purchases. All charges are processed immediately at checkout through our payment processor, Stripe.

  • Subscription credits reset at the beginning of each billing period and do not roll over.
  • Top-up credits purchased separately never expire and remain in your account.
  • Cancellation: You may cancel your subscription at any time from your dashboard. Your plan remains active until the end of the current billing period.

6. Refund Policy

Due to the digital nature of the Service, all sales are generally final. We may, at our sole discretion, provide refunds for unused subscription time in cases of service outages or billing errors. Top-up credits, once consumed, are not refundable. To request a refund, contact support@pokerbuddy.ai within 14 days of purchase.

7. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law
  • Share, resell, or redistribute your account credentials or Service access
  • Reverse engineer, decompile, or attempt to extract the source code
  • Use automated tools, scripts, or bots to access the Service beyond the provided client application
  • Create multiple accounts to circumvent usage limits or other restrictions
  • Interfere with or disrupt the Service or its servers
  • Use the Service in any jurisdiction where online poker or related tools are illegal

8. Compliance with Poker Platform Terms

You are solely responsible for ensuring that your use of PokerBuddy complies with the terms of service of any online poker platform you play on. Some platforms prohibit the use of third-party strategy tools. We make no representation that the Service is permitted on any specific platform. Use of the Service on platforms that prohibit it is at your own risk and may result in account penalties from those platforms.

9. Intellectual Property

All content, software, algorithms, and materials provided through the Service are owned by Dodo Labs LLC and protected by copyright, trademark, and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes, subject to these Terms.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT RECOMMENDATIONS PROVIDED WILL RESULT IN WINNING POKER HANDS. POKER INVOLVES CHANCE AND RISK OF LOSS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DODO LABS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

12. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason, with or without notice. Upon termination, your right to use the Service will cease immediately. Any unused subscription credits are forfeited upon termination for cause.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by the laws of the State of Wyoming, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in Wyoming.
